SWEEPSTAKES ENTRY PERIOD: The More Swipes More Style Sweepstakes (“Sweepstakes”) begins at 12:00 AM Eastern Daylight Time on May 1, 2013 and ending at 11:59 PM Eastern Daylight Time on June 30, 2013.

ELIGIBILITY: Sweepstakes is open to legal residents of the 50 United States and District of Columbia, age 18 or older at time of entry. Void where prohibited by law. Sponsor: Saks Fifth Avenue OFF 5TH, 362 Ninth Avenue, New York, NY 10001. Employees of Saks Fifth Avenue OFF 5TH ( the “Sponsor”), Red Fish Media, Ventura Associates International LLC, and their respective parent companies, subsidiaries, affiliates, retailers, distributors, suppliers, advertising and promotion agencies, and any other individual or company involved in the development or execution of the Sweepstakes (“Released Parties”), and members of their immediate families (parent, child, sibling and the respective spouses of the employees and all of the aforementioned) of same households of each, whether or not related, are not eligible to enter or win. Sweepstakes governed by U.S. law. All federal, state and local laws and regulations apply.

HOW TO ENTER: 
Method 1: You are automatically entered in this Sweepstakes drawing when you use your Saks Fifth Avenue Credit Card to make an in-store purchase at any Saks Fifth Avenue OFF 5TH Store ONLY. Limit: one (1) entry per day via this method. All non-purchase transactions, including but not limited to credits & other adjustment transactions, other similar fees & charges, credit, insurance premiums (& any other premiums) are not eligible for Sweepstakes entry.  Entries resulting from purchases made with lost, canceled, stolen or fraudulent cards are void.   Entries resulting from purchases made with a Saks Fifth Avenue Credit Card that does not have a valid email address or valid physical address associated with the card are void. Purchases from Saks Fifth Avenue stores and saks.com are not eligible for this sweepstakes.
Method 2: To enter via text message, text SAKSFIRST to short code 633584 and follow all subsequent instructions in its entirety (“Text Entry”).  Entrants entering via Text Entry must be a wireless service subscriber and must have a text messaging two-way capable handset and digital service in order to enter the Sweepstakes. Entrants may be charged for the text messages sent and received from handset according to the terms in their Customer Agreement with their service providers.  Standard text message rates apply.  Limit: one (1) entry per day via this method.
Method 3:  To enter online (no purchase necessary), visit www.rfmrules.com/off5th and follow online instructions to complete the online entry form (“Online Entry”) in its entirety.  Limit: two (2) entries per day via this method.
Regardless of method of entry: All entries must be received by 11:59:59 PM ET on 6/30/13.  Any additional entries received above the maximum limit per day will be disqualified.

Use of your Saks Credit Card to make a purchase and/or submission of an online entry or text entry constitutes your consent to participate in this Sweepstakes and your consent for Sponsor to obtain, use, and transfer your name, address and other information for the purpose of administering this Sweepstakes. Released Parties are not responsible for lost, late, damaged, illegible, garbled, inaccurate, misdirected, undelivered, delayed or incomplete entries. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of any automated, robotic, repetitive, programmed or similar entry methods or agents to participate is prohibited and will result in disqualification. Neither the Sponsor nor its designated agent assumes responsibility for third parties’ failure to act in accordance with Sponsor’s instructions pertaining to the implementation of the Sweepstakes. All entries, regardless of entry method, become the property of the Sponsor and will not be acknowledged nor returned.

PRIZE AND ITS APPROXIMATE RETAIL VALUE (“ARV”): One (1) Grand Prize: A $2,500.00 Saks Fifth Avenue OFF 5TH Gift Card (ARV: $2,500.00). Gift Card is for promotional purposes only and is not exchangeable for money or other alternative prize. It is non-transferable and not a coupon for discounts or markdowns. Gift Card cannot be redeemed as payment for purchases of gift card(s) or as an adjustment to prior purchases.  Gift Card may not be returned, redeemed for cash or used as payment on or credit to Saks Fifth Avenue credit card accounts. No credit or cash given for unused portion.  Gift Card will not be replaced if lost or stolen. Odds of winning depend on total number of eligible entries received during the Sweepstakes Entry Period.

WINNER SELECTION & NOTIFICATION: Potential Winner will be selected in a random drawing from all eligible entries received during the Sweepstakes Entry Period.  Random drawing will be conducted on or about 7/15/13 under supervision of an independent judging organization (“judges”) whose decisions are final and binding in all matters relating to this Sweepstakes. If potential winner originates from the transaction entries, prize will be awarded to the primary cardholder (as determined by Sponsor’s records). If potential winner submitted his or her entry via text message, the prize will be awarded to the name corresponding to the Mobile Telephone Number (MTN) from which the text message originated. If potential winner submitted his or her entry via online, the prize will be awarded to the name provided on the online entry form at time of entry.  Potential winner will be contacted via text, phone, email and/or overnight mail. If a potential winner is notified via text or email, he/she will be required to respond within seventy-two (72) hours with his/her contact information or he/she will be disqualified and an alternate winner will be selected in a separate random drawing. When the potential winner’s mailing address has been obtained, he/she will be notified via overnight carrier. Potential winner will be required to complete and return a notarized Affidavit of Eligibility and Liability and where permissible, a Publicity Release (“Affidavit/Release”), within ten (10) days of date specified on notification, or an alternate winner will be selected. If Affidavit/Release or prize notification letter is returned as undeliverable or if selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited and an alternate winner will be selected in a separate random drawing. If potential winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, all required documents must be signed and returned by the winner’s parent or legal guardian on minor’s behalf.

Prize will be awarded within approximately 30 days after receipt and verification of completed documentation. Prize is not redeemable for cash. Prize is non-assignable or transferable. No substitution is permitted except if a prize is unavailable, in which case a prize of equal or greater value will be awarded. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility. Winner is responsible for all federal, state, local and income taxes associated with winning his/her prize and will be required to furnish his/her social security numbers for the sole purpose of preparation of any tax forms as required by law. Except where prohibited by law, entry and acceptance of prize constitute permission to use winner's name, prize won, residence, likeness, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

RELEASE OF LIABILITY: By participating in this Sweepstakes, entrants agree to release and hold harmless the Sponsor, Red Fish Media, Ventura Associates International LLC, their respective parent companies, subsidiaries, affiliates, retailers, distributors, advertising and promotion agencies, suppliers and any other individual or company involved in the development or execution of the Sweepstakes (“Release Parties”), as well as the employees, officers, directors, shareholders and agents of each from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with possession, acceptance and/or use or misuse of prize or participation in the Sweepstakes. Sponsor is not responsible if Sweepstakes cannot be implemented due to delays or interruptions caused by acts of God, acts of war, natural disasters, weather, utility outages or acts of terrorism. Winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Sweepstakes or use or redemption of any prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize.

As a condition of entering the Sweepstakes, entrant agrees that (1) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses, (2) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action and shall be resolved exclusively by arbitration under the rules of the American Arbitration Association; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney’s fees.

RESTRICTIONS: Recipient of prize must have a U.S. mailing address. If you enter by text message, you must have a valid wireless MTN and account. In the event of a dispute as to any registration, the authorized account holder of the email address or the MTN used to register (at time of entry) will be deemed to be the registrant.  The “authorized account holder” is defined as the natural person who is assigned a MTN or email address by his/her carrier or an Internet access provider, online service provider or other organization responsible for assigning email addresses  as shown on his/her carrier’s records for the domain associated with the submitted address.  The potential winner may be required to show proof of being the authorized account holder. By participating in this Sweepstakes by text message entries, all entrants authorize their respective carriers to provide Sponsor and its designated agent with their text messaging phone number.

Release Parties (as defined above) are not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, transaction processing, theft, destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, phone lines, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or any injury or damage to entrant’s or any other person’s cell phone or computer related to or resulting from participating in the Sweepstakes or inaccurate entry information, whether caused by equipment, programming used in this Sweepstakes, human processing error, or otherwise. By participating in the Sweepstakes, entrants (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and/or the independent judging organization, which are final and binding in all matters relating to the Sweepstakes.  Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. The Sponsor reserves the right to (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw the text message method of entry, the transaction method of entry and/or online method of entry if it becomes technically corrupted, (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes), and to select the winner(s) from among all eligible entries received prior to withdrawal.

Legal Warning: ANY ATTEMPT BY AN individual, whether or not an ENTRANT, TO DELIBERATELY DAMAGE, destroy, tamper or vandalize OR interfere with the OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS and THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES and diligently pursue all remedies against ANY SUCH individual TO THE FULLEST EXTENT PERMITTED BY LAW.

You must acquire a total of 2,500 points in a calendar year in order to receive a SaksFirst gift card. The 2,500 point minimum can consist of any combination of base points or bonus points. All SaksFirst customers earn 2 base points per eligible dollar spent from $1-$4,999 for calendar year-to date net purchases. At the $5,000 eligible net spend threshold, SaksFirst customers will earn 4 base points per eligible dollar thereafter up to $9,999 on calendar year-to-date net purchases.
